1. Definitions
“Producer” means Canggu Dating Club and its parents, affiliates, licensees, successors and assigns.
“Program” means the live dating show entitled “Canggu Dating Club,” including any pre- or post-show gatherings, promotions, teasers, trailers, or related events.
“Activity” means on-stage dating and any associated post-show gatherings or events.
“Materials” means all audio, video, photographs, biographical information, social media content, performance, and other contributions by Participant.
2. Voluntary Participation
Participant’s involvement in the Activity is entirely voluntary. Producer has no obligation to cast Participant, include any Materials, or provide compensation or benefits of any kind.
3. Grant of Rights
Participant hereby grants Producer and its designees a perpetual, worldwide, royalty-free, sublicensable and transferable license to:
- Record, film, photograph and capture Participant’s image, voice, performance, and biographical information;
- Edit, reproduce, distribute, exhibit, display, broadcast, and otherwise exploit the Materials in any media now known or hereafter devised (including advertising, trailers, YouTube, social media, and promotional materials);
- Use Participant’s name, likeness, voice, social media posts, and other personal identifiers in conjunction with the Program and related promotions.
4. Ownership & “Works Made for Hire”
All Materials and any creative contributions (including scripts, vlogs, blogs, photos) are “works made for hire” owned exclusively by Producer. To the extent any Materials are not “works made for hire,” Participant assigns all rights, title and interest therein to Producer, including copyrights and any moral rights.
5. Representations & Warranties
Participant represents and warrants that:
- They are at least 18 years old and legally able to enter this Agreement;
- They are in good physical and mental health and free from any condition that could interfere with safe participation;
- They have no disqualifying criminal convictions or registrations as a sex offender;
- They will comply with all local, regional, and national laws, venue rules, and Producer’s on-stage directions;
- The Materials do not infringe the rights of any third party or contain defamatory, obscene, or illegal content;
- They will not attempt to reproduce, distribute, or exploit the Program concept or format without Producer’s written consent.
6. Assumption of Risk & Release
Participant acknowledges that the Activity may involve physical or emotional risk. Participant voluntarily assumes all risk of injury, loss or damage. To the fullest extent permitted by law, Participant releases Producer and its affiliates from any and all claims, demands, liabilities, or causes of action arising out of participation in the Activity or use of Materials.
7. Indemnification
Participant agrees to indemnify, defend and hold harmless Producer and its affiliates from any losses, damages, liabilities, claims, or expenses (including attorneys’ fees) arising from Participant’s breach of this Agreement, negligent or willful acts, or any third-party claims related to the Materials.
8. No Casting or Compensation Guarantee
Producer has no obligation to cast Participant on the Program or include any Materials. Participant will receive no payment, wages, benefits, or reimbursement, except such modest travel, accommodation, or refreshments as Producer may choose, in its sole discretion.
9. No Liability for Injuries
Producer is not liable for any personal injury, property damage, or other harm that may occur in connection with the Activity, including on-stage and post-show gatherings in Bali, Indonesia.
10. Confidentiality of Production Details
Participant may not disclose any confidential production details (such as rehearsal processes, audience reactions, editing decisions) to third parties prior to public broadcast. This obligation survives termination.
11. Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of Indonesia. Any dispute arising hereunder shall be brought exclusively in the courts of Bali, Indonesia, and Participant hereby submits to the personal jurisdiction of such courts.
12. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement & Amendments
This Agreement constitutes the entire understanding between the parties regarding its subject matter and supersedes all prior agreements. Producer may amend these terms at any time by updating the “Last updated” date above. Continued participation constitutes acceptance of the revised terms.
